TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may suspend or discontinue Services for maintenance, updates, or other reasons.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART GLASSES TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data or information
  • Business interruption
  • Personal injury or property damage
  • Loss of privacy

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Smart Glasses Tech, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through our Services

13. Termination

You may terminate your account and stop using our Services at any time by contacting customer support or following the account closure process.

13.2 Termination by Us

We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including:

  • Fraudulent or illegal activity
  • Non-payment of fees

13.3 Effect of Termination

Upon termination:

  • You remain liable for any outstanding obligations
  • Provisions that should survive termination will continue to apply

14. Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

14.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action, collective action, or representative proceeding.

14.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or other urgent matters that cannot wait for arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last updated" date
  • Notify you of material changes via email or service notification
  • Provide a reasonable notice period before changes take effect

Your continued use of our Services after changes take effect constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and Smart Glasses Tech regarding the use of our Services.

19. Developer-Specific Terms

19.1 SDK License

20. Enterprise Terms
